1. Introduction
Funded Academy Ltd. (“Company,” “we,” “us,” or “our”) is a technology company providing services through fundedacademy.com(the “Website”). These services include, but are not limited to, proprietary trading evaluations involving Contracts for Difference (CFDs) and Futures Contracts. These Terms and Conditions (the “Terms”) govern the legal relationship between the Company and its users (“User,” “Customer,” or “you”) with respect to access to and use of the Website and Services.
2. Agreement and Modifications
These Terms constitute the entire agreement between you and the Company. We reserve the right, at our sole discretion, to amend or modify these Terms at any time. Any such modifications shall become effective immediately upon publication on the Website. It is your responsibility to review the Terms prior to each use of the Services.
3. Service Evolution
To ensure the ongoing quality, security, and integrity of the Services, the Company reserves the right, at any time and without prior notice, to modify, enhance, suspend, or discontinue any aspect of the Website, platform, or Services, whether temporarily or permanently.
Such modifications may be implemented for reasons including, but not limited to:
- Adapting to technological developments or infrastructure changes;
- Responding to variations in user activity, volume, or engagement;
- Complying with changes to third-party licenses, software providers, or commercial partnerships;
- Preventing misuse, abuse, manipulation, or other activities that may harm the Company, its Users, or third parties; and
- Addressing legal, regulatory, security, or risk management requirements.
The Company shall not be liable for any loss, damage, or inconvenience resulting from such modifications, suspensions, or discontinuation of Services.
4. Acceptance of Terms
By signing, clicking “I Agree” or “Accept,” or otherwise accessing or using the Services, you acknowledge that you are entering into a legally binding agreement with the Company. You confirm that you have read, understood, and agreed to be bound by these Terms and the Privacy Policy.
Important: If you do not agree with any provision of these Terms or any subsequent amendments, you must immediately discontinue all use of the Services.
5. Definitions
5.1 Core Terminology
- Account: A centralized user dashboard that provides access to the platform, allowing users to access Services, manage subscriptions, enroll in programs, and maintain personal information.
- User: Any individual who accesses or browses the Website or registers for an Account.
- Evaluation Stages: A one-step or two-step simulated evaluation process designed to assess trading performance. These stages provide access to simulated trading software, analytical tools, educational materials, and support services to evaluate eligibility for a Trader role.
- Forbidden Territories: Jurisdictions where the Company does not offer Services. These include: Afghanistan, Antigua and Barbuda, Bangladesh, Belarus, Belize, the Balkans, Bouvet Island, Burma (Myanmar), Burundi, Canada, Cape Verde, Central African Republic, Chad, Comoros, Cook Islands, Cuba, Democratic Republic of the Congo, Eritrea, Ethiopia, Fiji, Grenada, Hong Kong, Iran, Iraq, Lebanon, Libya, Malaysia, Mali, Myanmar, Nicaragua, North Korea, Russia, Somalia, South Sudan, Sri Lanka, Sudan, Syria, Tuvalu, Ukraine (Crimea, Donetsk, and Luhansk regions), United Kingdom, United States, Venezuela, Vietnam, and Yemen.
- Trader: A User who, upon successful completion of the Evaluation Stages and the User Verification Process, may be granted the opportunity to trade using Company capital.
- KYC (Know Your Customer): The mandatory identity verification process conducted to confirm the identity of Users and applicable Ultimate Beneficial Owners, and to assess regulatory and compliance risks.
- Trading: Instructions executed by Users within simulated environments that replicate real market conditions using fictitious funds.
- Intellectual Property: All worldwide proprietary rights, whether registered or unregistered, including patents, copyrights, trademarks, trade secrets, domain names, confidential business information, and any renewals or extensions thereof.
6. Sanctions Regime
The “Sanctions Regime” includes all applicable economic or financial sanctions, trade embargoes, and anti-terrorism laws imposed by governmental or international authorities, including but not limited to:
- The United States (OFAC, Department of State, and Department of Commerce);
- The United Nations Security Council;
- The European Union;
- The United Kingdom; and
- Any other jurisdiction applicable to the Company’s operations.
7. Eligibility
7.1 Account Registration
While the Website may be browsed without registration, access to the trader portal and Services requires a registered Account. The Company reserves the right, in its sole discretion, to accept or reject any Account application.
7.2 Eligibility Criteria
To be eligible for an Account, you must:
- Be at least eighteen (18) years of age or the legal age of majority in your jurisdiction;
- Have full legal capacity to enter into these Terms;
- Not qualify as a retail trader;
- Not reside in, or operate from, any Forbidden Territory; and
- Remain in continuous compliance with these Terms.
7.3 AML and KYC Policies
The Company maintains strict Anti-Money Laundering (AML) and Know Your Customer (KYC) procedures. Identity verification may be required at any stage, including after successful completion of an Evaluation Stage. You agree to provide government-issued identification and any additional documentation requested. The Company may engage third-party verification providers. Changes in risk profiles or regulatory requirements may result in Account restrictions or termination.
8. Sanctions and Legal Restrictions
The Company operates in strict compliance with all applicable sanctions, export controls, and anti-terrorism laws. Access to, or use of, the Services is strictly prohibited where such access or use would violate any applicable law, regulation, or sanctions regime.
8.1 User Responsibility
You acknowledge and agree that you are solely responsible for determining whether your access to and use of the Services is lawful in your jurisdiction. Accessing the Website or Services from a location where such access is prohibited is done entirely at your own risk.
8.2 Revocation of Access
The Company reserves the right to immediately suspend, restrict, or terminate your access to the Services if your use is determined, or reasonably suspected, to be in violation of any applicable laws, regulations, or sanctions requirements.
8.3 Prohibited Circumvention
Any attempt to circumvent geographical, regulatory, or sanctions-based restrictions, including through the use of VPNs, proxy servers, false declarations, or other technical or deceptive means, constitutes a material breach of these Terms.
By using the Services, you represent and warrant that you are not located in, a resident of, or otherwise operating from a prohibited or sanctioned jurisdiction.
9. Intellectual Property License
9.1 Limited License
The Company grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Website and Services for personal, non-commercial purposes only. No ownership rights are transferred.
9.2 Ownership
All rights, title, and interest in the Website, Services, and related Intellectual Property remain exclusively with the Company. All rights not expressly granted are reserved.
9.3 Usage Restrictions
Unless expressly authorized in writing, you may not copy, modify, distribute, sublicense, reverse engineer, create derivative works from, or commercially exploit any part of the Website or Services.
10. Registration, Verification, and Accounts
Account information must be accurate, current, and consistent with payment provider records. Only one Account per User is permitted. Account sharing, transfer, or resale is strictly prohibited. You are responsible for maintaining accurate contact information.
11. Services and Evaluations
The Company provides access to simulated trading evaluation programs designed to assess trading discipline, risk management, and consistency. These evaluations are offered through one-stage or two-stage challenge formats, each governed by specific rules and parameters published on the Website.
11.1 Experience Requirement
The Evaluation programs are intended for individuals who already possess prior trading knowledge and experience. The Services are not designed for beginners, and the Company does not provide personalized training or investment guidance.
11.2 Simulated Trading Environment
All trading activity conducted during the Evaluation stages is performed in a simulated environment. The funds displayed within the platform are entirely fictitious, have no real-world monetary value, and do not represent actual capital. You acknowledge that:
- No real trades are executed in live financial markets;
- No profits generated during simulated trading are real or withdrawable;
- You acquire no ownership or proprietary interest in any simulated funds; and
- Performance during simulated trading may not reflect real-world trading conditions.
11.3 Evaluation Fees
Participation in Evaluation programs requires payment of a one-time fee, the amount of which varies depending on the selected program. The Evaluation fee grants access solely to the simulated environment, platform tools, and educational resources. Except as expressly stated in these Terms, Evaluation fees are non-refundable.
11.4 No Guarantee of Advancement
Successful completion of any Evaluation stage does not guarantee that you will pass the User Verification Process or be offered the opportunity to become a Trader. The Company retains sole discretion in determining eligibility based on compliance, risk assessment, and internal criteria.
12. Payments and Refunds
12.1 Currency and Taxes
All fees for Evaluation programs are denominated in United States Dollars (USD). If payment is made in another currency, conversion shall be performed by the payment processor at its applicable exchange rate. All fees are inclusive of applicable taxes unless otherwise stated.
You are solely responsible for determining and satisfying any tax obligations arising from your use of the Services.
12.2 Payment Methods
Payments may be made using the payment methods made available on the Website, including credit or debit cards, bank transfers, or other supported options. You are responsible for any fees charged by your payment provider and must ensure that the full Evaluation fee is received by the Company.
12.3 Refund Policy
Evaluation fees are generally non-refundable. Once you have placed any trade or otherwise commenced trading activity within an Evaluation account, you irrevocably waive any right to a refund.
12.4 Limited Refund Eligibility
A refund request may be considered only if all of the following conditions are satisfied:
- No trading activity has occurred on the Evaluation account;
- The refund request is submitted within seven (7) calendar days of the original purchase date; and
- You have complied fully with these Terms and have not engaged in any prohibited conduct.
The Company reserves the right to deny any refund request that does not strictly meet the above criteria.
13. User Content
By submitting content to the platform, you grant the Company a perpetual, irrevocable, worldwide, royalty-free license to use such content. You are solely responsible for ensuring your content complies with applicable laws and third-party rights.
14. Termination and Prohibited Practices
14.1 Termination for Cause
The Company reserves the right to immediately suspend, restrict, or terminate your Account and access to the Services, with or without prior notice, if the Company reasonably determines that:
- You have engaged in fraudulent, deceptive, or criminal conduct;
- Your activities violate AML, KYC, sanctions, or other regulatory requirements;
- You have materially breached these Terms and failed to cure such breach within ten (10) business days, where cure is permitted;
- You have initiated unjustified chargebacks or payment disputes; or
- You have used the Services for unauthorized commercial purposes or made defamatory or misleading statements about the Company.
14.2 Prohibited Trading Practices
The following activities constitute material violations of these Terms and may result in immediate termination of your Account and forfeiture of any associated benefits or rewards:
- Arbitrage trading or exploitation of pricing discrepancies;
- High-frequency trading involving extremely short trade durations;
- News trading, tick scalping, latency abuse, or system exploitation;
- Copy trading or coordinated trading across multiple accounts;
- Use of unauthorized Expert Advisors or third-party trading software;
- Account sharing, resale, or trading on behalf of another individual; and
- Circumvention of geographical or regulatory restrictions.
14.3 Automated Trading Software
Use of automated or algorithmic trading software is permitted only with prior written approval from the Company. Any approved software must be personally owned or developed by you. You assume full responsibility for any intellectual property or compliance issues arising from such use.
15. Risk Disclosures and Liability
The Services do not constitute financial or investment advice. Simulated trading results do not reflect live market performance. To the maximum extent permitted by law, the Company’s total liability is limited to the greater of USD 100 or the amount paid for Services in the preceding month.
16. Miscellaneous
- The Company may disclose information to authorities as required by law.
- Electronic acceptance of these Terms is legally binding.
- The English version of these Terms shall prevail.
- Provisions relating to Intellectual Property, liability, and confidentiality survive termination.
